There are two types of visas that would allow you to work in the U.S., temporary work visa petitions and EB3 immigrant (green card) visa petitions.
Fees associated with the filing of temporary work visa petitions, e.g.H-1B, such as filing fees and attorney’s fees are supposed to be shouldered by the petitioner/employer. The reason being that the employer will primarily benefit from the filing of the temporary work visa petitions.
However, fees associated with the filing of EB3 immigrant petition (green card), such as attorney’s fee, filing fee with the USCIS ($700.00), immigrant visa fee ($325.00), medical exam fee ($207.00) and green card fee ($220.00), are supposed to be shouldered by the applicant/beneficiary the reason being that the applicant will primarily benefit from the EB3 sponsorship in that the applicant will get a green card from the USCIS.
EB3 sponsors may consist of hospitals, nursing and rehab centers and other healthcare facilities such as home health care agencies and agencies for nurses and other health care professionals such as physical therapists and occupational therapists.
Hospitals may be willing to shoulder EB3 fees (attorney, filing and visa fees) in some instances, but it is very hard to get hospitals to sponsor under the EB3 visa category since they are usually a part of a bigger hospital system.
Smaller health care facilities such as nursing and rehab centers, home health care agencies and nursing agencies may not be able to afford fees associated with the EB3 sponsorship.
In view of the above, we can state that in regard to the question of who will shoulder the fees associated with the filing of the EB3 petitions (first step) and applications for immigrant visa and alien registration (permanent residence/green card), it can be stated that it would depend on the financial situation of a given EB3 sponsor and the applicant. There are instances that a given EB3 sponsor may not be in a position to shoulder the fees (although as stated above, they are NOT required to shoulder the fees associated with the EB3 sponsorship), but a given applicant may be in a position to shoulder to shoulder the said fees (again, note that under EB3 sponsorship, applicants are supposed to shoulder the fees associated with it).
In other words, as to the question as to who will shoulder the fees associated with the EB3 sponsorship, the answer is that it will be taken up on a case-by-case basis depending on the financial situation of the EB3 sponsor and the applicant.
In all the cases, no EB3 petition process will commence until the applicant has been made aware as to what the fees are and who will shoulder the said fees. In some instances, there may be a situation where the EB3 sponsor may be willing to reimburse the fees paid the applicant provided the applicant abides by and finishes the term of the employment contract. The employment contract may be executed by the EB3 sponsor and the applicant before the filing of the first step EB3 petition. However, it may be executed after the EB3 petition filing if circumstances warrant such as in case the applicant is in transit elsewhere.
Regarding the Job Offer which the EB3 sponsor has to give to the applicant, it will be given to the applicant just prior to the visa interview since the US Embassy/Consulate requires the date indicated in the Job Offer to be current as of the day of the visa interview.
Yes. Spouse and/or minor (less than 21 yrs. old) children can be included in the sponsorship petition, but there may be additional legal fees.

One year, more or less, from the date of the filing of the immigrant petition to the actual visa interview provided the EB3 visa category is CURRENT based on the Department of State Visa Bulletin.
